Release of Liability, Waiver, and Assumption of Risk

Please read carefully before signing.

Assumption of Risk

I understand that participation in dance classes, movement workshops, cultural arts activities, and community events ("Activities") offered by Tala Mai Moana involves inherent risks, including but not limited to:

• Physical injury from dance movements, stretching, or exercise
• Muscle strains, sprains, or other bodily injuries
• Slips, trips, and falls
• Injuries resulting from physical contact with other participants or equipment
• Aggravation of pre-existing conditions

I acknowledge that these risks may result in injury to myself or others. I voluntarily assume full responsibility for any risks of loss, property damage, or personal injury, including death, that may be sustained as a result of participating in Activities.

Waiver and Release of Liability

In consideration of being permitted to participate in Activities, I, for myself, my heirs, personal representatives, and assigns, hereby release, waive, discharge, and covenant not to sue Tala Mai Moana, its owners, officers, directors, employees, instructors, volunteers, agents, and representatives (collectively "Released Parties") from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by me or my property while participating in Activities.

This release applies regardless of whether the loss, damage, or injury is caused by the negligence of the Released Parties or otherwise.

Indemnification

I agree to indemnify and hold harmless the Released Parties from any loss, liability, damage, or costs, including court costs and attorney fees, that may be incurred due to my participation in Activities, whether caused by my negligence or otherwise.

Medical Acknowledgment

I certify that:

• I am physically fit and have no medical condition that would prevent my participation in Activities
• I have disclosed any relevant medical conditions to the instructor (optional disclosure below)

I understand that Tala Mai Moana does not provide medical advice and that I should consult a physician before participating if I have any concerns about my physical condition.

In the event of an emergency, I authorize Tala Mai Moana to seek emergency medical treatment on my behalf if I am unable to do so myself. I accept responsibility for all costs associated with such treatment.

Photo and Video Release

I grant Tala Mai Moana permission to photograph and/or record me during Activities and to use such photographs and recordings for promotional purposes, including but not limited to social media, website, marketing materials, and community outreach.

Acknowledgment and Agreement

I have read this Release of Liability, Waiver, and Assumption of Risk in its entirety. I fully understand its terms and understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing this agreement freely and voluntarily, and intend my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.

For Participants Under 18 Years of Age

I am the parent or legal guardian of the minor named above. I have read and understood this Release of Liability, Waiver, and Assumption of Risk, and I agree to its terms on behalf of myself and the minor participant. I accept full responsibility for any and all risks associated with the minor's participation in Activities.

This document shall be governed by and construed in accordance with the laws of the State of California. If any provision of this agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.
